1. Who you are contracting with
BizLink Zambia (“the Service”) is operated by Elisha Phiri, trading as EPhiz Tech Solutions, a sole trader based in Lusaka, Zambia (“we”, “us”, “our”). By using the Service you are entering into an agreement with us.
2. Acceptance of these terms
By creating an account or continuing to use the Service you agree to these terms. If you are using the Service on behalf of a company, you confirm you have authority to bind that company. If you are using it as an individual, you confirm you are of legal age to enter into a contract.
3. What the Service provides
BizLink Zambia is a software platform for small and medium businesses. It lets you maintain a business profile, store compliance documents, browse tender and funding opportunities, see match scores, track bids, manage customers, invoices and expenses, and use AI features that analyse opportunities and draft proposals.
4. Your account
You must give accurate information and keep it up to date. You are responsible for keeping your login details confidential and for all activity carried out under your account.
5. Acceptable use
You must not use the Service:
- for any unlawful purpose, or to commit fraud, send spam or mislead buyers or funders;
- to infringe anyone’s intellectual property or privacy rights;
- to interfere with security — no malware, no probing or scanning, no scraping, no circumventing technical limits or usage quotas;
- to reverse engineer, resell or redistribute the Service or any part of it.
6. AI features: your responsibilities
The Service includes generative AI features. When you use them you agree that:
- you will not use them to create illegal content, deepfakes, hate speech, harassment, malware, or to attempt to jailbreak or misuse the underlying models;
- you are responsible for the prompts and documents you submit, for having the rights to that content, and for how you use the output;
- you retain the rights you hold in the content you submit, and you may use the outputs generated for your own business, including in bids and proposals;
- outputs may be inaccurate, incomplete or out of date. They are not legal, financial, tax or professional advice. You must check every proposal, analysis, figure and deadline against the original tender documents before relying on them or submitting anything.
We may remove or restrict content, filter or refuse outputs, and suspend accounts where use breaches these terms. If you believe content on the Service infringes your rights, contact us and we will review it and remove infringing material; accounts that repeatedly infringe will be terminated.
7. Opportunity information
Tender, grant and funding listings are gathered from public and third-party sources. We make reasonable efforts to keep them accurate but we do not guarantee that a listing is current, complete or correct. Always verify with the issuing buyer or funder.
8. Intellectual property
We own the Service and all intellectual property in it, including the software, design, branding and documentation. You receive a limited, non-exclusive, non-transferable right to use the Service under the plan you have selected. You keep ownership of the business data and documents you upload; you grant us a limited licence to host and process them solely to provide the Service to you.
9. Payment, subscriptions and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, renewal, cancellation and refund mechanics are governed by Paddle’s Buyer Terms. Our own refund commitment is set out in our Refund Policy. Paid plans renew automatically each billing period until cancelled.
10. Service availability
We work to keep the Service available, but we do not guarantee uninterrupted or error-free performance. Maintenance, third-party outages and factors beyond our control may affect access.
11. Suspension and termination
We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel at any time. On termination you may export your data for 30 days, after which it may be deleted.
12. Warranties and liability
To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect or consequential loss, including lost profits, lost contracts, lost data or loss of goodwill. Our total aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law.
13. Indemnity
You will indemnify us against claims arising from the content you submit, your unlawful use of the Service, or your breach of these terms.
14. General
These terms are governed by the laws of the Republic of Zambia and the courts of Zambia have jurisdiction. You may not assign your rights without our consent; we may assign ours in connection with a merger or sale of the business. Neither party is liable for delays caused by events beyond reasonable control. We may update these terms and will post the revised version on this page.
